Creative Intersection Pty Ltd (“Creative Intersection”, “we”, “us”, “our”) respects your privacy. This policy explains what personal information we collect, why we collect it, how we handle it, and the choices and rights you have. We are bound by the Privacy Act 1988 (Cth) and the Australian Privacy Principles (APPs).

The short version

  • We collect the details you give us (enquiries, the system check, invoices, job applications) plus basic usage data as you browse.
  • We use it to reply to you, run our business, and improve our content, nothing more.
  • We communicate one-to-one. We do not run marketing mailing lists, and we never sell your information.
  • Your data is hosted in Australia; a few trusted providers (Google, Stripe) process some of it overseas.
  • You can see it, correct it, or complain at any time. Details at the end.

1. Who this policy applies to

This policy applies to personal information we collect through this website (creativeintersection.com), our online tools and forms, and in the course of providing our services and running our business. “Personal information” means information or an opinion about an identified individual, or an individual who is reasonably identifiable.

2. What information we collect

The kinds of personal information we collect depend on how you interact with us:

  • Enquiry and contact details: when you use our contact form, email or call us: your name, email address, phone number, the organisation you represent, and whatever you choose to tell us in your message.
  • How you found us: when you submit an enquiry we also record how you heard about us (from a short menu) and the web page you arrived from, so we can understand which of our content is useful.
  • “Replace your system?” check: if you use our online business-system self-assessment, we collect the answers you select and, only if you choose to have your result emailed to you, your email address. For each submission we store a one-way, de-identified reference rather than your raw IP address.
  • Payment and billing information: if you pay an invoice online, your payment is processed securely by Stripe. We receive limited transaction details (such as confirmation and the amount). We do not collect or store your full card number.
  • Job applications: if you apply for a role with us, the information contained in your application, résumé and any supporting documents.
  • Website and device information: like most websites, we automatically collect technical information such as your IP address, browser and device type, the pages you view and how you reached them, through server logs, cookies and analytics (see section 4).
  • Sensitive information: we do not generally collect sensitive information (such as health, racial or ethnic origin, or political or religious beliefs). If we ever need to, we will only do so with your consent or where the Privacy Act otherwise permits.

3. How we collect it

Wherever reasonable and practicable, we collect personal information directly from you: when you complete a form, use one of our tools, email or phone us, apply for a job, or engage us for work. Some information is collected automatically as you use the website (see section 4). Occasionally we may receive information about you from a third party, such as a referral; where that happens, we take reasonable steps to make you aware of it.

4. Cookies, analytics and reCAPTCHA

  • Cookies. Our website uses cookies (small files stored on your device) to make the site work and to measure how it is used. You can control or delete cookies through your browser settings, though some parts of the site may not work as well without them.
  • Google Analytics. We use Google Analytics to understand how visitors use the site, for example, which pages are read. This uses cookies and collects usage data, and is subject to Google’s privacy terms. You can opt out using the Google Analytics Opt-out Browser Add-on.
  • Google reCAPTCHA. Forms on our site, such as our contact form, are protected by Google reCAPTCHA, which helps us tell real people from automated abuse. It collects hardware and software information and is subject to the Google Privacy Policy and Terms of Service.
  • Google Search Console. We use Search Console to understand how the site performs in search results. It does not identify you individually.

5. Why we collect and use it

We collect and use personal information to:

  • respond to your enquiries and provide the information, quotes or services you ask for;
  • provide, support and improve our services and this website;
  • process payments, and manage our client relationships and records;
  • consider and manage job applications;
  • understand which of our content is useful, so we can create more of it; and
  • meet our legal and regulatory obligations.

We may also use it for a related secondary purpose you would reasonably expect. We communicate with you directly, one-to-one. We do not run bulk marketing mailing lists, and we do not sell your personal information.

6. When we disclose it

We disclose personal information only:

  • to the service providers who help us run our business and website, for example Stripe (payment processing), Google (analytics and reCAPTCHA), and our hosting and email providers, and only so they can perform those services for us;
  • where you have consented; or
  • where we are required or authorised to do so by law.

We take reasonable steps to ensure anyone who handles personal information on our behalf protects it consistently with this policy and the APPs.

7. Overseas recipients

Our website and the personal information we hold are primarily hosted in Australia. However, some of the service providers described in section 6 process or store information overseas. For example, Google (analytics and reCAPTCHA) and Stripe (payments) may process information in the United States and other countries. Where we disclose information to an overseas recipient, we take reasonable steps to ensure it is handled in a way consistent with the Australian Privacy Principles.

8. How we store and protect it

We hold personal information in electronic and, where relevant, physical form, and take reasonable technical and organisational steps to protect it from misuse, interference and loss, and from unauthorised access, modification or disclosure.

We keep personal information only for as long as we need it for the purposes described in this policy, or as required by law. Business and financial records, for example, are generally kept for a minimum of seven years. When information is no longer needed, we take reasonable steps to destroy it or permanently de-identify it.

9. Data breaches

We are covered by the Notifiable Data Breaches scheme under the Privacy Act. If we become aware of a data breach that is likely to result in serious harm to affected individuals, we will notify those individuals and the Office of the Australian Information Commissioner (OAIC) as required by law.

10. Accessing and correcting your information

You may ask to access the personal information we hold about you, and to have it corrected if it is inaccurate, out of date or incomplete. Please contact us in writing (see section 14). We may need to verify your identity before releasing information. We do not charge a fee for making a request, although we may charge a reasonable amount to cover the cost of providing copies. If we cannot give you access or make a correction, we will explain why in writing.

11. Complaints

If you have a concern or complaint about how we have handled your personal information, please contact us first (see section 14) so we can try to resolve it. We will acknowledge your complaint and respond within a reasonable time. If you are not satisfied with our response, you can refer your complaint to the Office of the Australian Information Commissioner (OAIC): oaic.gov.au · 1300 363 992.

12. Links to other sites

Our website may contain links to other sites. We are not responsible for the content or the privacy practices of those sites, and we encourage you to read their privacy policies.

13. Changes to this policy

We may update this policy from time to time to reflect changes in our practices or the law. The current version is always available on this page, with the effective date shown. Where changes are significant, we will take reasonable steps to make them clear.
